These Terms govern access to and use of the website ecaduran.com and the services offered by Ecaduran S.A.S. By using the site, you agree to be bound by them.
1. Provider identification
Ecaduran S.A.S., an Ecuadorian company with Tax ID 1793215480001, with registered office at Av. Amazonas N39-123 y Arizaga, Quito, Pichincha, Ecuador. Contact email: legal@ecaduran.com.
2. Purpose
Ecaduran operates a platform that intermediates loans backed by mortgages on real estate located in Ecuador. The platform connects real estate developers seeking financing with investors willing to lend capital.
3. Registration and verification
To invest, you must register, provide truthful information and pass the identity verification (KYC) process. Ecaduran reserves the right to reject incomplete or fraudulent registrations, or registrations inconsistent with AML/CFT regulations.
4. Nature of the investments
The operations published are loan agreements with a mortgage guarantee. They are not tradable securities or obligations of Ecaduran. Ecaduran does not guarantee the payment of principal or interest: the obligation lies with the borrowing developer.
5. Risks
Investing in real estate crowdlending involves risks, including payment delays, enforcement of the guarantee, illiquidity of the property and the possible total or partial loss of principal. You must assess your risk profile before investing.
6. Fees
Using the site and registering are free of charge. Ecaduran charges the developer an origination fee and a management fee, both disclosed in each contract. Investors do not pay subscription fees.
7. Intellectual property
The site, its code, trademarks, logos and content are the property of Ecaduran S.A.S. or its licensors. Reproduction without prior written authorisation is prohibited.
8. Modifications
Ecaduran may amend these Terms at any time. Changes will be published with the last-updated date. Continued use of the site implies acceptance of the current version.
9. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Ecuador. Any dispute shall be submitted to the competent courts of the Quito Canton, Province of Pichincha, unless the law provides otherwise on a mandatory basis.
